Breach Bond Review

The Department of Homeland Security (formerly Immigration Naturalization Service – INS) may breach (forfeit) an Immigration Bond, but there could be defenses to the breach. Some of these defenses are apparent on the face of the documents or within the “A” file.

The DHS Form I-323 “ Notice – Immigration Bond Breached” outlines why and when the noncitizen failed to appear for removal (deportation), or interview or departure (for a Voluntary Departure Bond).
